⇛ Shiyaa Aurat aur Mard se Nikaah,

✪ Jo sakhsh Hazrat Ali Raziyallahu Anhu ki khudayi ka qaa’il ho ya Qurane kareem ko Tehreef shuda maanta ho, Ya Ummul momineen Hazrat Aayesha Raziyallahu Anha per zina ki tohmat rakhta ho Ya Hazrat Abu Bakar Siddiq Raziyallahu Anhu ki Sahabiyat ka munkir ho, Ya Hazrat Jibra’iyl Alaihissalam ki wahi laane me galti ka aqeeda rakhta ho, Ya koi aur Kaafirana aqeeda rakhta ho, Wo kaafir he, Daayra e islam se khaarij he,
⇛ Lihaza agar koi Shiya ladki in aqaa’id ki haamil ho to usse Sunni musalman Ka Nikaah halaal nahi,
⇛ Agar kufriya aqaa’id na rakhti ho to fi nafsa Nikaah mun’aqd ho ja’ega fir bhi usse Nikaah se Mard ke aqeeda kharaab ho Jane ka zyada andesha he, isliye isse bachna laazim he,

★ Agar koi Shiya kufriya aqaa’id rakhta he to uske saath Sunni Ladki ka Nikaah Kaafir hone ki Vajah se mun’aqd nahi hoga,
→ Aur agar Kufriya aqaa’id na rakhta ho tab bhi wo mubtda’a aur Faasiq he, Us Sunni Ladki ka Nikaah nahi ho sakta kyuki wo Faasiq hone ki Vajah se Sunni Ladki ka Kafu nahi,

✪ Jo ladki Aqidah e Ahle Sunnat val Jama’at ki haamil aur Fiqah ko maanne wali khususan Imaam Abu Hanifa Rh ke maanne wali ho uska Nikaah Gair Muqallid ( Ba qoal khud Ahle hadees) ladke se fi nafsa mun’aqd ho jata he, Kyuki wo bhi Muslim he,
fir bhi esi jagah Rishta karne me amuman khandano ke aapas me ikhtilaf payda ho jata he, Kyuki Ahadees ki roshni me Mard v Aurat ki Namaz me 13 maqamaat me farq he, aur bhi kai buniyadi masail he’n Jinme Ahle sunnat aur Gair Muqallideen ka ikhtilaf he,
⇛ To unke yaha’n Shadi ki soorat me Mard aur uske khandan wale ladki ko unke masail me Gair Muqallideen ki per I karne per majboor karte he’n, Jisse aapas me na chaqi payda hoti he, isi tarah baaz digar masail me bhi tashaddud karte he’n,
⇛ isliye unko ladki dene se hattal imkaan ahatraaz kiya jaye,

⇛ Gair Muslim ka quboole islam aur uska Nikaah,
✪ Agar koi kaafira Aurat islam qubool kare, to agar wo Aurat esi ho k uska koi shohar nahi, to usse fora Nikaah durust he,
⇛ Agar uska Shohar mojood he to fir uska hukm ye he k agar wo bhi musalman ho jaye tab to ba dastoor ye Aurat uski Bivi rahegi, dono ka Nikaah barqarar he,
⇛ Agar Shohar islam qubool karne se inkaar kare to unme tafreeq kar di jaye, Ye tafreeq ba hukm Talaaq hogi,
✪ Agar ye Aurat Darul Harb me ho to islam qubool karne ke waqt se teen haiz guzaar kar uska Nikaah khatm hoga, Agar haamla ho to vaza hamal per uska Nikaah khatm hoga, uske baad iddat guzaar kar Nikaah karna chahiye, Yahi ahoot he,

✪ Agar Aurat islam qubool karke Darul Harb se Darul islam hijrat karke aa jaye to Darul islam me dakhil hote hi uska Nikaah khatm ho jayega, is per vajoob e iddat me ikhtilaf he, qoal e vajoob arjah aur ahoot he,

⇛ Nav Muslima ke liye Kaafir Shohar ke Nikaah se nikalne ka Tareeqa,

✪ Agar koi kaafir Aurat islam qubool kare to asal Hukm to yahi he k uske Shohar per islam pesh kiya jaye, Agar qubool kare to dono ka Nikaah barqarar rahega, Agar inkaar kare ya khamoshi akhtyar kare to qazi unme tafreeq kar de to ye tafreeq ba-hukm talaaq hogi, aur iske baad iddat waajib hogi,
✪ Lekin agar Shohar per islam pesh karne me mushkilaat ho ya isme shadeed khatra he, Esi majboori ki soorat me kaafir Shohar se khalasi haasil karne ke liye Mazhab Shafai per amal karne ki gunzaish he,
✪ Unke yaha ( Shafai ) Aurat ke quboole islam ke baad Shohar ke islam qubool karne se pehle agar Aurat ki iddat guzar jaye to Nikaah fasikh ho jata he aur uske baad foran doosra Nikaah ho sakta he,
✪ Shohar ke islam qubool karne ke baad doosri iddat ki zarurat nahi,

✪ Nikaah me chunki ye zaruri hota he k 2 gawaah majlise Nikaah me haazir ho aur iyjaab v qubool dono sune, isliye Teliphone per Nikaah durust nahi hota,
✪ Agar doosre Shahar Ya Mulk me Nikaah karna ho to iska sahi tareeqa ye he k us Shahar me ( Yani jisme Ladki he ) kisi shakhs ko apne Nikaah ka Vakeel muqarrar kare, Vakeel uski taraf se doosre fareeq ke saath gawaho ki mojoodgi me iyjaab v qubool Kare, is tarah Nikaah sahi ho jayega,

⇛ Tehreeri Nikaah ka Hukm,

✪ Tehreer ke zariye bhi Nikaah ho sakta he, magar ye zaruri he k tarfeen me se ek ki jaanib se Nikaah ke qubooliyat ka zabani izhaar ho aur sirf ek hi tarah se Tehreer ho,
✪ Qubuliyat ka izhaar 2 gawaaho ke saamne kiya jaye, aur wo Tehreer bhi un gawaho ke saamne padhkar suna di jaye,
⇛ Maslan Zaid Hindah ko likhe k mene tumse ek Tola Sona Mahar per Nikaah kiya, Hindah ke paas jab ye Tehreer pahunche to wo avval 2 gawaaho ko talab kare, Unko ye Tehreer suna de aur fir unke saamne kahe k me ise qubool karti hu’n, Ab Nikaah mun’aqd ho jayega,
⇛ Agar Hindah Tehreer padh kar gawaho ko na sunaye balki sirf apni qubooliyat ka izhaar unke saamne kare ya zabani izhaar ki bajaye sirf Tehreer likh de, aur usi per gawaho ke dastkhat karaye, ya gawaho ke dastkhat bhi na karaye, in tamaam soorato me Nikaah na ho sakega,

⇛ Nikaah ke Waqt Waldiyat galat batana,

✪ Baaz log doosre ki Aulaad ladka ya ladki lekar parvarish karte he’n, Ab kisi jagah unki waldiyat batani pade to apni taraf mansoob kar dete he’n,
( Yani apna naam bata ya likha dete he’n)
⇛ Nikaah ke waqt bhi ye maamla pesh aata he to hukm ye he k apni waldiyat hamesha apne asal waalden ki batani chahiye, Sotele baap ki taraf nisbat karna jaa’iz nahi, Hadees me is per sakht wa’ied aayi he,
⇛ Lekin agar Nikaah ke waqt galat waldiyat bata di gayi magar Aurat ya uska Vakeel Jaanta tha, k isse muraad konsa Mard he ya konsi Aurat he to Nikaah durust ho jayega,
✪ Rasulullah Sallallahu Alaihivasallam ne irshad farmaya k,
” Jisne apne Baap ke alawa kisi gair ki taraf nisbat ki halanki wo jaanta he k uska Baap koi aur he, Us per jannat Haraam he, ”

⇛ Galti se Ladki ka Naam Badal gaya,

✪ Agar galti se Nikaah ke waqt naam badal gaya maslan Zenab bint Bakar ka naam Khalida bint Bakar keh diya ya Zenab bint Umar keh diya vagera, ab Agar shadi ke gawaah ladki ko pehchante ho k fala’n Zenab bint Bakar ka hi nikaah ho raha he, Ya wo ladki majlise Nikaah me khud mojood he aur uski taraf ishara karke Nikaah padhaya aur gawaah bhi pehchan rahe he’n k isi ladki ka Nikaah ho raha he, To naam galat batane ke bavjood ye Nikaah mun’aqd ho jayega,
⇛ Aur agar ladki majlise Nikaah me mojood na ho aur na hi uski taraf ishara hua aur gawaaho ko mutaiyan tor per maloom nahi k fala’n Zenab bint Bakar hi ka Nikaah ho raha he, in sab soorto me Nikaah mun’aqd na hoga, dobara shara’it ke saath Nikaah padhana zaruri he,
⇛ Goonge Ke Nikaah ka Tareeqa,

✪ Goonge ka Nikaah is tarah padhaya jayega k do gawaho ki mojoodgi me Goonge se Nikaah qubool karne ka ishara kara diya jayega, Jisse iyjaab qubool mafhoom ho,
⇛ Aur sunne walo ko iski muraad maloom ho jaye, Yani usse talaffuz bhi karwaya jaye,

⇛ Tajdeed Nikaah kab laazim he?

✪ Baaz alfaz kufriya hote he’n, Kabhi qasdan aur kabhi la ilmi me ya kabhi gusse me ese alfaz moonh se nikal jaye, maa’ani v matlab ke lihaaz se Ulma ke nazdeek uska qaail kaafir thehre,
✪ isi tarah Rasulullah Sallallahu Alaihivasallam ki kisi Sunnat ki qasdan toheen ki jisse wo shakhs tehqeeq haal ke baad kaafir thehra,
✪ Ya koi aur esa masla pesh ho jiski vajah se Ulema muhaqqeen ne us shakhs ke kaafir ka fatwa saadir farmaya,
⇛ Esa shakhs agar apni nazeba harkat aur fayl se tauba kare aur islaam me dakhil ho jaye to us per laazim hoga k tajdeed imaan ke saath tajdeed Nikaah bhi kare,
⇛ Aur jis masle me ikhtilaf ho k isse kufr saadir hua ya nahi hua, waha ahatyatan tajdeed imaan v tajdeed Nikaah ka hukm kiya jata he,

⇛ Yani wo dono gawaah ye samjhe k in dono Miya Bivi ke darmiyan naya Nikaah ho raha he, Sirf mazaaq ya dillagi na samjhe varna Nikaah mun’aqd na hoga,

✪ Esi soorat me Jo samaan mojood ho unko waapas liya ja sakta he aur Jo halaak ho chuke ho yo kha pi liya unki waapsi nahi ho sakti,
✪ Haa agar Ladki walo ne inkaar nahi kiya balki khud Ladke walo ne inkaar kar diya to kuchh bhi waapas nahi liya ja sakta,

✪ Ek rivaaj ye chala he k Shuru me badi miqdaar me Mahar Tay kar liya jata he, Nikaah form me bhi likha jata he aur Nikaah ke waqt sabke saamne iyjaab v qubool me is bhari Mahar ka zikr kiya jata he k itne Mahar ki avaz me Nikaah qubool kiya,
✪ Lekin baad me mukhtalif heele bahano ke zariye Mahar Maaf karwane ki koshish ki jati he,
✪ Pehle guzar chuka he k Mahar khalis Aurat ka haq he, Usko haq mahar me tasarruf ka mukammal akhtyar he, Shohar ya kisi aur ko Mahar waapas lene ya Aurat ki razamandi ke bager usme tasarruf karne ka bilkul akhtyar nahi, aur zabadasti maaf karwane se maaf bhi nahi hoga,
✪ Aur ye bhi yaad rahe k zabardasti maaf karwana ye dar haqeeqat maafi nahi balki ek tarah ka gasab he k zabardasti Aurat ke haq per qabza kar liya,
✪ Shar’an isko maaf karna bhi nahi kaha ja sakta isse Shohar ka zimma faarig na hoga, Zindgi me Ada karna laazim rahega, Agar zindgi me Ada nahi kiya to Marne ke baad unke tarke se Mahar ka qarz vasool karke Bivi ke hawale kiya jayega,

✪ Mahar e Misl ka matlab ye he k Aurat ke Baap ke gharane me se Jo Aurat uske misl ( Barabar ki ) ho,
✪ Yani agar ye kam umar he to wo bhi Nikaah ke waqt kam umar ho, agar ye khoobsurat he to wo bhi khoobsurat ho, Jis ilaaqe ki ye rehne wali he usi ilaaqe ki wo bhi ho, Agar ye Deendar hoshiyar ya saliqamand, Padhi likhi he to wo bhi esi hi ho,
✪ Garz Walid ke khandan me Jo Aurate’n in baato me uski tarah thi, unka Jo Mahar Tay hua tha wohi uska Mahar e Misl he,
