✿ 2- Agar Talaaq Baa'in di thi aur Talaaq ke waqt Shohar tandurast tha ,chahe Talaaq Aurat ki marzi se di ho ya marzi ke bager ,fir iddate Talaaq khatm hone se pehle Shohar ka inteqal ho gaya ,to ab Aurat sirf iddate Talaaq hi jitni baqi reh gayi ho Wo poori karegi ,iddate Wafaat nahi guzaregi aur Shohar ki Vaaris bhi nahi hogi ,

✿ 3- Agar Talaaq e Baa'in ke waqt Shohar bimaar tha aur Talaaq Aurat ki marzi se di thi to is soorat me bhi wahi Hukm he Jo ouper bayan huva k Aurat Sirf iddate Talaaq hi jitni reh gayi Wo poori karegi ,iddate Wafaat nahi guzaregi aur Shohar ki Vaaris bhi nahi hogi ,

✿ Sar dhona aur Nahana iddat me Jaa'iz he ,Zarurat ke waqt Kanghi karna bhi durust he ,Jese kisi ne sar dhoya ya Ju pad gayi ,lekin patti na jhukaye na bareek Kanghi se Kanghi kare ,jisme Baal Chipke hue jate he'n ,balki mote Dandane wali Kanghi kare k zeenat na hone paye ,

⇛Yani jab Mayyat ne kuchh maal hi nahi chhora to Wo farokht karne wala jisne apni cheez ki Qeemat nahi payi aur Wo qarzkhwah jiska Qarz abhi vasool nahi huva un Cheezo ko Jo unke Qabze me mojood he Farokht karke sabse pehle apna haq le sakta he ,unka haq ada ho Jane ke baad agar kuchh baqi rahe to Wo Tarka samjha jayega aur usme Tajheez v Takfeen, Qarz v Vasiyat aur miraas qayde ke mutabiq jari honge ,aur agar kuchh baqi na rahe to Azeez Rishtedar Apne paas se Tajheez v Takfeen kare ,

✿ Mayyat Ke Tarke se sabse pehle uski Tajheez v Takfeen ka kharch liya jaye ,magar ye kaam bhut sidhe saade Sharai tareeqe se Sunnat ke mutabiq kare aur Kafan bhi Mayyat ki haisiyat ke mutabiq de ,Kapda safed hona chahiye lekin esi qeemat ka ho jis qeemat ka kapda aksar pehna pehan ka Ghar se bahar nikalta aur logo se milta tha,aur Masjid v Bazar me jata tha,na itni kam qeemat ka ghatiya ho aur na itna besh qeemat ho jisme israaf ho ,aur Qarz khawaho aur Vaariso ke haq me nuqsaan aaye ,

✿ Mayyat ki taraf se Sadqa karna bila Shubha bahut pasandida aur baa'ise sawab he aur Mayyat ko iska sawab pahunchta he ,lekin Sadqaat usi waqt pasandida aur naafe ho sakte he'n k Shariyat ke muwafiq ho ,Shariyat Hukm deti he k haqdaaro aur Yateemo ke maal per haath saaf mat karo ,balki jis kisi ko Tofeeq ho apne halaal maal se Sadqa kare ,isliye laazim he k pehle Tarka ki Taqseem Shara'i qaayde se kar li jaye ,fir Baalig Vaaris apne hisse me se Jo Chahe de ,Taqseem se pehle hargiz na dena chahiye,

Agar bataya jata k isne itna maal chhora he k Qarz ada karne ke liye kaafi he to us per Namaz ( Janaza ) padhte ,Varna Aap Sallallahu Alaihivasallam Sahaba Kiraam se farma dete k ,is per tum Namaz padh do ,

✿ Sahih Hadees me ishara he k Momin ka jab tak Qarz ada na kar diya jaye uski Rooh ko ( Sawab ya Jannat me dakhila se ) roka jata he ,

Ek Shakhs ne arz kiya :- Ya Rasulallah ! Mere Bhai ka inteqal ho gaya aur Chhote Bachche chhor gaya he ,Kya me un per maal kharch karu ( aur Qarz ada na karu ? )

Aap Sallallahu Alaihivasallam ne farmaya k ,Tumhara Bhai Qarz ki vajah se muqeed he ,Qarz ada karo ,

📓 Mufidul Variseen ,40  bahawala Mishkaat,

✿ Agar Tajheez v Takfeen aur Tadfeen ke baad baqi Tarka tamaam Qarzo ki adaaygi ke liye kaafi he to bila kisi farq ke tamaam Qarze ki adaaygi ki jaye aur agar Kaafi nahi aur Qarz sirf ek Shakhs ka he to Jitna Tarka Tajheez v Takfeen aur Tadfeen se bacha he Wo sab usko de diya jaye ,baqi Wo agar chahe to maaf kar de ya Akhirat per moqoof rakhe ,

✿ Agar Tajheez v Takfeen aur Tadfeen ke baad bacha hua Tarka Qarzo ki adaaygi ke liye kaafi nahi aur Qarz kai Aadmiyo ka he to Wo unme kitna kitna kis tarah taqseem hoga ? Aur kis Qism ke Qarz ko doosre Qarz per muqaddam kiya jayega ? Iski tafseel kisi Sahibe Fatwa Mustanad Aalime Deen ko poori soorate haal bata kar maloom kar liya jaye ,ya Kitaab " Mufidul Variseen " ka bagor mutala kiya jaye ,

✿ Agar Tajheez v Takfeen aur Tadfeen ke baad Tarka bilkul na bache ya itna thoda bacha kar sab Qarze usse ada na ho sake to baqi Qarzo ka ada karna Vaariso ke zimme waajib nahi ,

⇛Haa'n Muhabbat ka taqaza aur behtar pasandeeda yahi he k Jitna ho sake Mayyat ki taraf se Qarze ada karke usko Raahat Pahunchaye ,

    ☞ Allah Ta'ala ke Qarzo ki Adaaygi, --1,

✿ Allah Ta'ala ke Qarze yana Huqooq ( Faraiz v Waajibaat ) reh gaye ho ,

Maslan-- Namazo ,Rozo ka Fidya ,Zakaat ,Hajj ,Sadqatul fitr ,Nazar ya Kaffara vagera esa reh gaya tha Jo Mayyat ne ada nahi kiya tha, to inka Hukm ye he k Agar Bando ke tamaam Qarze ada karne ke baad Tarka me kuchh maal baqi rahe aur Mayyat ne Allah ke in Huqooq ko ada karne ki Vasiyat bhi ki ho to is bache hue maal ke ek tihaai ( 1/3 ) me se in Huqooq ko Ada kiya jaye ,

⇛ Agar ek tihaai me Wo poore ada na ho sake to Jitne ada ho sake ada kar de ,Tihaai se zyada maal kharch karke unko. Ada karna Vaariso per laazim nahi ,kyuki baqi do tihaai ( 2/3 ) maal Vaariso ka he ,Lihaza Aaqil Baalig vaariso ko akhtyar he k Chahe to apne apne hisse aur maal me se kharch karke un baqi huqooq ko bhi Ada kare aur Mayyat ko Akhirat ke muwakhze se bachaye ,aur khud bhi sawab kamaye ,

⇛( Lekin majnoon ya Na-balig Vaariso ka hissa isme kharch karna hargiz Jaa'iz nahi, agarche Wo ba khushi ijazat de de )aur Chahe to do tihaai maal sab Vaaris Sharai hisso ke mutabiq Aapas me taqseem kar le ,is soorat me Allah Ta'ala ke Jo Huqooq ada hone se reh jayenge unki Zimmedari Mayyat per hogi ,Vaariso se koi muwakhza na hoga ,

✿ isi tarah agar tihaai maal itna ho k Allah Ta'ala ke sab Huqooq usse ada ho sakte ho lekin Marne wale ne sirf baaz huqooq ada karne ki Vasiyat ki aur baqi Huqooq ki nahi ki Ya itne kam maal ki Vasiyat ki k usse Wo sab Huqooq ada nahi ho sakte ,Maslan -- tihaai maal 2000 tha jisse sab Huqooq ada ho sakte the ,lekin mayyat ne sirf 1500 Rupiya Kharch karne ki Vasiyat ki to Vaariso per Adaaygi sirf Vasiyat ki had tak laazim hogi ,poore 2000 kharch karna laazim na hoga ,Albatta Marne wala poore Huqooq ki Vasiyat na karne ki Vasiyat na karne ki vajah se gunahgar hoga ,

⇛1- Ek ye k Bando ke Qarzo ka ada karna Mayyat ki Vasiyat per mokoof nahi ,balki Vasiyat ki ho tab bhi Tajheez v Takfeen ke baad unka ada karna Farz he ,aur Allah Ta'ala ke Huqooq ka ada karna Mayyat ki Vasiyat per mokoof he ,Vasiyat na kare to unka ada karna Vaariso per laazim nahi ,

⇛2- Doosra Farq ye he k Bando ka Qarz ada karne me koi had nahi thi ,Tajheez v Takfeen ke baad saara Tarka bhi usme kharch ho jaye to Kharch karke ada karna Farz he ,aur Allah Ta'ala ke  Huqooq ko Bando ke tamaam Qarze ada karne ke baad Jo Tarka bache uske sirf ek tihaai me se ada karna farz he ,tihaai se zyada Kharch karna Vaariso per laazim nahi ,

⇛3- Teesra Farq zaahir he k Allah Ta'ala ke Huqooq ka ada karna usi soorat me Farz he jabki Bando ke tamaam Qarze ada ho chuke ho ,

    Meri ek choti bhabi hai jo bewa hai wo shaadi se inkaar kar rahi hai ki uska shohar yani mera bhai ye wasiyat kar gaya ki uske marne ke baad wo doosra nikah na kare uski ek 14 saal ki bachi hai uske khatir kiya uski ye wasiyat jayaz hai mai mere bhai se 2 saal bada hoon aur meri biwi ka bhi inteqal hogaya mai usse shaadi karna chahta hoon kiya ye jayaz hai
